Smokers could land a £200 fine for smoking at work, but is this the same for vapers?

With more people picking up vaping as an alternative to cigarettes, many may be unaware of the rules when it comes to vaping on the job. 

Smoking is illegal in any enclosed workplace, public building or public transport, but e-cigarettes don’t fall under the same laws. However, it’s important to use e-cigarettes in a respectable way whilst at work to avoid any trouble with your employer. 

To stay on the right side of HR, David Phillips from Vape Superstore has revealed what your legal rights are to vaping at work. 

“The rules on vaping at work aren’t the same as smoking, and can vary depending on your location and your employer’s policies, so it’s important to be aware of your rights to avoid any trouble.”

Company policy

“Familiarise yourself with your employer’s vaping policies. Understand where vaping is permitted, if at all, and if there are any designated vaping areas. Violating these policies could result in disciplinary action, including warnings, fines, or even termination depending on the severity and frequency of the offence.”

Local regulations

“Research local laws and regulations regarding vaping in public places, including workplaces. Some jurisdictions may have restrictions on vaping indoors or in certain types of workplaces, but it’s up to you to find if you are legally allowed to vape in your local workplace.”

Safety considerations 

“Be mindful of safety hazards associated with vaping devices. Vaping devices often use lithium-ion batteries and heating elements, which could pose fire risks if mishandled or used improperly. Employers may impose fines for potentially causing safety hazards in the workplace, so remember to remain responsible.”

Professionalism and productivity 

“Avoid disruptions to your work environment caused by vaping. Excessive vaping breaks or vaping in non-designated areas could be perceived as unprofessional or disruptive to productivity. Employers or those in HR may enforce fines or other consequences for behaviour that negatively impacts the workplace environment.”

Smoking at work

“The laws on smoking and vaping at work differ, but it’s important to be aware of the potential fines associated with smoking. If you are caught smoking within your workplace you could be fined up to £200, or up to £50 in Scotland. Although this fine doesn’t apply to e-cigarettes, it is up to employers’ jurisdiction on whether they are allowed to be used on their premises or not, meaning that you could risk a fine much like smoking on work premises.”
